1The applicant has referred a grievance concerning the interpretation, application, administration or alleged violation of a collective agreement to the Board for final and binding determination.
2Prior to the hearing in this matter the parties entered into the following Memorandum of Agreement:

MINUTES OF SETTLEMENT
BETWEEN
The International Union of Painters & Allied Trades District Council 46, (Local Union 1795),
Applicant,
- and -
City Window & Glass,
Responding Party.
WHEREAS the Applicant has filed a grievance against the Responding Party.
AND WHEREAS the grievance has been referred under s.133 of the Labour Relations Act, as Board File #0789-01-G.
AND WHEREAS the parties are desirous of settling all matters relating to the above mentioned grievance.
Now Therefore the parties agree as follows:
The Responding Party acknowledges that it is bound to the Collective Agreement effective May 28, 1998 – April 30, 2001 and renewals thereof between Architectural Glass and Metal Contractors Association and International Union of Painters & Allied Trades and the Ontario Council of the International Union of Painters and Allied Trades.
The Responding Party shall forthwith pay to the Applicant the sum of two hundred dollars ($200.00) in full settlement of all matters relating to the grievance.
This settlement shall be without precedent and without prejudice to the parties respective positions.
This settlement shall form part of a Board order and the Board is hereby requested to issue same.

3Having regard to the Minutes of Settlement, to the representations before it and pursuant to section 133 of the Labour Relations Act, 1995, the Board makes the following determination:
City Window & Glass is bound by the collective agreement effective May 28, 1998 – April 30, 2001 and renewals thereof between Architectural Glass and Metal Contractors Association and International Union of Painters & Allied Trades and the Ontario Council of the International Union of Painters and Allied Trades.
City Window & Glass shall pay to the applicant the sum of $200.00 in settlement of this grievance.
