Decision of the Board
1A consultation was held in this matter on May 16 and 24, 2001. Based on the submissions of the parties, the Board determined that there were substantive facts in dispute and issues of credibility. As a result, a hearing will be held to determine whether the National Hockey League Players Association has violated the Labour Relations Act, 1995, as amended (“the Act”), and in particular section 74 of the Act in its representation of Mr. Vincent Reindeau. The hearing will be held on November 19, 20, 29 and 30, 2001 commencing each day at 9:30 a.m. at 505 University Avenue, 2nd Floor.
2The employer party to the collective agreement did not attend the consultation. Although it appears that the National Hockey League had notice of the application, it was not noted as an Intervenor in the file. The Board determined that the National Hockey League has the right to intervene in this application. Accordingly, the Board directed the National Hockey League Players Association to advise the Board as to the proper contact person for the National Hockey League. That person is:

3If the National Hockey League intends to intervene in this matter, it is directed to file its intervention with the Board and the other parties by Monday, September 10, 2001.
4The hearing will be de novo and no decision will be made based on the submissions received at the consultation.
5The Registrar is directed to ensure that a copy of this decision is provided to the National Hockey League as set out above.
