Decision of the Board
1This is an employer appeal filed pursuant to section 68 of the Employment Standards Act, R.S.O. 1990, c. E.14, as amended ('the Act') against Order to Pay No. 56221 issued by an Employment Standards Officer on March 26, 2001 (“the Order”).
2The application was filed on August 28, 2001, after the amount payable under the Order was collected for the Ministry by a collection agency. Appeals against Employment Standards Officers’ orders must be filed within 45 days of their being made. This application was filed more than 5 months after the Order was issued. It is very late. The Board may extend the time for the filing of an appeal for good reason. No reason for the delay has been furnished in this case. The Board will therefore not exercise its discretion to extend the time period for the filing of the appeal.
3The application is dismissed.
