1952-99-ES Ritchie Baird, Applicant v. Paul Almas et al, Jane Wilkins, Employment Standards Officer and Ministry of Labour, Responding Parties.
Employment Practices Branch File No. 63000205
BEFORE: Harry Freedman, Vice-Chair.
DECISION OF THE BOARD; October 24, 2001
1. The Board (differently constituted) in a decision dated October 23, 2000 adjourning this application sine die for a period not exceeding one year noted that at the hearing of this matter on October 19, 2000 that counsel for the applicant and counsel for the Ministry of Labour had requested an adjournment of this application sine die to enable the appointment of an officer to consult with the parties and attempt to effect a settlement. The Board observed in that decision that the request was unopposed and indicated that unless within that time either party requests that the Board proceed with the matter, it would be deemed terminated without any further notice to the parties.
2. Counsel for the applicant, in a letter filed with the Board on October 19, 2001, advised that she and counsel for the Employment Standards Officer and Minister of Labour had agreed to request an extension of the adjournment “for an appropriate period to enable the parties to consult with the Board in terms of its October 23, 2000 order and to attempt to effect a settlement of the matter”.
3 The Board, at the request of the applicant and with the consent of the Inspector and Ministry of Labour, hereby adjourns this application sine die for a period not exceeding one year from the date of this decision. Unless a party to this application requests that the Board proceed with the application within that one year period, the application will be deemed to have been dismissed without any further notice to the parties.
