This is a section 96 complaint which was filed in November 1999. In the interim, the parties have had settlement discussions and this matter has been adjourned on two occasions. This matter was scheduled for hearing on Friday, June 8, 2001 and the Board received, in addition to the pleadings, further representations from the parties and based on the representations received, the submissions of the parties, the Board orders that the responding party pay $15,000.00 to the applicant in Trust, to be distributed equally (i.e. $2,500.00 each) to:

Roger Burnette.
This is a complete and final settlement of the section 96 complaint and therefore, the complaint is terminated. The Board notes that this is a full and final resolution of the complaint and the union has acknowledged that it has no further complaints under the collective agreement.
