DECISION OF THE BOARD; September 6, 2001
This is an application filed pursuant to section 96 of the Labour Relations Act, 1995 (the “Act”) alleging that the responding party (the “union”) has violated section 74.
The union has asserted that the application fails to disclose a prima facie violation of the Act and that the Board ought to exercise its discretion to not inquire into the matter any further.
In a decision dated August 10, 2001, the Board provided the applicant a further opportunity to respond.
The applicant has done so.
Having considered the material the Board is not prepared to dismiss this matter without a hearing.
This matter is directed to the Registrar to schedule a consultation hearing in accordance with the normal practice.
