1This is a referral of a construction grievance concerning the interpretation, application, administration or alleged violation of a collective agreement filed pursuant to the provisions of section 133 of the Labour Relations Act, 1995 ('the Act').
2The applicant has asked that the Board determine the referral without a hearing and with reference only to the material filed, in the event the responding party fails to file a Request for Hearing and Notice of Intent to Defend. There has been no such Request and Notice. The applicant is therefore in a position to have the Board decide the matter by default.
3What is not clear from the application is how the Trustees determined the sum of $47,217.95 to be the appropriate security they require. The applicant is directed to advise the Board how this amount is arrived at so that its request for a default decision can be dealt with.
