DECISION OF THE BOARD; November 7, 2001
This is an application filed under section 96 of the Labour Relations Act, 1995 (the “Act”) alleging a breach of section 74 of the Act.
By letter dated November 6, 2001, counsel for the responding union asserts that the application pertains to a federal undertaking and is not within the jurisdiction of the Board. The responding union also asserts that it did not receive the Board’s Confirmation of Filing although that was sent to the applicant at the same fax number as is contained in the fax cover sheet of counsel’s letter.
The responding union shall have 5 days from the date of this decision to provide submissions as to the material facts upon which it relies in support of its position that the Board does not have jurisdiction to hear this matter. The Board will then determine how to proceed.
The response to this application is to be filed in the normal course.
I remain seized to deal with the submissions in respect of the jurisdictional issue.
