1This is an application brought pursuant to section 43 of the Labour Relations Act, 1995, S.O. 1995, c. 1, as amended (the “Act”).
2Board File No. 0498-01-R is an application brought pursuant to section 63 of the Act for a declaration that the responding party the Service Employees’ International Union, Local 210 (the applicant in Board File No. 0465-01-FC) no longer represents the employees in the bargaining unit for which it is the bargaining agent at Saint Elizabeth Health Care.
3A vote was ordered in Board File No. 0498-01-R and that file is still in progress with no final decision having been rendered. That file involves the same bargaining unit as is involved in Board File No. 0465-01-FC.
4A hearing was scheduled in Board File No. 0465-01-FC for May 28, 29, 30 and 31, 2001.
5In accordance with the provisions of sections 43(23.1) and 43(23.2) the Board is mandated to deal with the decertification application before dealing and continuing with a first contract application involving the same bargaining unit.
6In the circumstances the hearing scheduled for May 28, 29 30, and 31, 2001 is hereby adjourned sine die until a final decision has been rendered in Board File No. 0498-01-R.
