1This is an employee appeal of the decision by an Employment Standards Officer not to issue an Order to Pay against the responding party.
2A hearing was scheduled for December 3, 2001 at 9:30 a.m. at the Board’s offices.
3At the time set for the hearing neither the applicant or the responding party appeared for the hearing. Accordingly, the Board stood down.
4At 10:00 a.m. the Board reconvened the hearing. The applicant was still not present. The Board has reviewed its file and it appears that the applicant was sent a notice of hearing. Indeed, there is a decision of the Board dated November 28, 2001, which confirms the hearing date.
5Accordingly, the application was dismissed by oral decision at the hearing. This decision confirms that ruling.
Disposition
6The application is dismissed.
