This is a referral of a grievance to the Board for determination under section 133 of the Labour Relations Act, 1995, S.O. 1995, c.1 as amended ("the Act").
Prior to the hearing in this matter the parties entered into the following Minutes of Settlement and Consent Order:

MINUTES OF SETTLEMENT & CONSENT ORDER
BETWEEN:
UNIVERSAL WORKERS UNION, LIUNA LOCAL 183,
“UNION”

A-1 WALLS CONCRETE FORMING (DIV. OF 1304056
ONTARIO INC.),
“EMPLOYER”.
The parties hereby agree to settle the dispute between them as set out in these minutes and request the Board to incorporate them into an order.
The “Employer” states that it has subsequently changed the name of the Corporation and requests that this order reflect the new name as set out above. The new name is A-1 Walls Concrete Forming (Division of 1304056 Ontario Inc.)
The “Employer” agrees that it is bound by the Collective Agreement as between the Universal Workers Union, LIUNA Local 183 and the Low Rise forming Contractors Association effective May 1, 1998 to April 30, 2001 and continuing.
The “Employer” agrees that it violated the Collective Agreement by failing to make timely remittances to the various Health Welfare & Pension funds as outlined in the Collective Agreement.
The “Employer agrees that it will pay to the Union forthwith the sum $25,644.49.
