DECISION OF THE BOARD; May 17, 2001
1This is an application for certification.
2It would appear that the only outstanding issue relates to the applicant’s status as a trade union within the meaning of the Labour Relations Act, 1995.
3The responding party has indicated that if the Board is satisfied with the status of the applicant a certificate should issue without a hearing.
4The applicant, in support of its claim, points the Board to its own Board Files 4127-98-U and 0125-01-R. The Board has reviewed decisions in these files and is unable to identify any previous finding as to the applicant’s status as a trade union.
5The applicant is hereby directed to file with the Board and deliver to the responding party, within 10 days of the date of this decision, any and all materials and submissions upon which it relies to support its claim to be a trade union.
6The responding party will then have up to five days after receiving them, to review those materials and submissions and to advise the Board whether or not it is content to have the Board determine the issue of trade union status on the basis of the materials filed and without an oral hearing.
