DECISION OF THE BOARD; October 30, 2001
1This is an application pursuant to the Employment Standards Act for review of an order to pay (No. 58477) issued by an Employment Standards Officer. The hearing of this matter was scheduled to resume on October 18, 2001, following the Board’s decisions dated July 19, 2001 and August 7, 2001. However, on October 18, 2001, the applicants indicated, in writing, the following:
A hearing in this matter was to take place on October 18, 2001 to resolve the entitlement of some employees whose entitlement had not previously been resolved. The appelants (sic) hereby accept that the entitlement of all employees, not heretofore resolved, is as set out in the Ministries’ (sic) assessment which is Schedule A in its proof of claim.
As this resolves all matters in dispute, the Board may issue a final decision in this matter. The appelants (sic) intend to seek judicial review of Vice-Chair Brown’s decision of July 19, 2001 which found that Dundas Realties Limited and Schoeny Corp. Limited are related businesses for the purposes of the Employment Standards Act.
2Accordingly, there being no further issues to be decided by the Board, this matter is terminated.
