DECISION OF THE BOARD; May 9, 2001
This is an application for certification made pursuant to the construction industry provisions of the Labour Relations Act, 1995, S.O. 1995 ch. 1 (the "Act"). The parties have agreed to deal with two of the issues arising from this application separately from any of the other issues. Pursuant to the agreement of the parties, the Registrar is directed to schedule one day of hearing to deal with the issues set out in the letter of counsel for the applicant dated May 3, 2001, namely:
(i) whether or not the application for certification was properly delivered on the responding party; and
(ii) whether the responding party is to be permitted to make any submissions to the Board on the basis that it did not file the response in a timely manner and whether or not the responding party is permitted to resile from its original position prior to retaining counsel.
