DECISION OF THE BOARD; December 19, 2001
1. These are related matters. Board File 2637-01-G is a Referral of Grievance under Section 133 of the Labour Relations Act, 1995 as amended (the “Act”). Board File 2638-01-R is a sale of a business/related employer application under Section 69 and/or Subsection 1(4) of the Act. The applicant has requested that they be consolidated and heard together and has waived the time limits for the Referral under Section 133 of the Act.
2. Counsel for the responding party, Durigon Brothers Construction Ltd., has requested an extension to file responses in both applications for reasons set out in letters dated December 17, 2001 (2638-01-R) and December 18, 2001 (2637-01-G).
3. The December 17 and 18, 2001 letters do not indicate whether copies were sent to the applicant. Counsel for Durigon Brothers Construction Ltd. is directed to send copies to the applicant and advise the Board.
4. The Board directs these matters be processed together for all purposes including hearings and Labour Relations Officer meetings.
5. The time for filing replies in these matters is extended to January 11, 2002.
6. These matters are referred to the Registrar and the Manager of Field Services.
