DECISION OF THE BOARD; October 1, 2001
- This is an application for the referral of a grievance to arbitration pursuant to section 133 of the Labour Relations Act, 1995, S. O. 1995 ch. 1 (the "Act"). Before the hearing of this matter by the Board, the parties entered into Minutes of Settlement which provide as follows:

THE ONTARIO COUNCIL OF THE INTERNATIONAL UNION OF PAINTERS AND ALLIED TRADES, (LOCAL UNION 114) (the “Applicant”)
and
DOUG’s PAINTING & DECORATING (the “Responding Party”)
MINUTES OF SETTLEMENT AND CONSENT ORDER
The parties agree to settle this matter on the following terms and request that the board incorporate the following in a decision as a consent order.
A Declaration that the Responding Party is bound to the Collective Agreement between the Ontario Painting Contractors Association, Acoustical Association Ontario, Interior Systems Contractors Association of Ontario and the International Union of Painters and Allied Trades and the Ontario Council of the International Union of Painters and Allied Trades (the “Collective Agreement”).
A Declaration that the Responding Party has agreed to abide by the full terms and conditions of the Collective Agreement.
A Declaration that the Responding Party has violated the Collective Agreement, and in particular, Articles 2, 5, 12, 13, 14, 15, 16A, 16B, 16C, 17, 18, 19, 20A, 20B, 21, 23, 25, 28, 35 & 35.01 of Appendix “A”.
An order that the Responding Party shall pay to the Applicant the sum of Five Thousand dollars ($5,000.00) in accordance with the payment scheduled attached as Schedule “A” hereto as full and final settlement of this matter.
In the event of default in any payment, the Responding Party agrees the entire amount less any payments received shall become immediately due and payable.
