1This is an employee appeal under section 68 of the Employment Standards Act, R.S.O. 1990 c. E-14, as amended (the "ESA") against the refusal by an Employment Standards Officer to issue an Order to Pay in the applicant's favour.
2The responding employer contends that it is subject to an Order of the Superior Court of Justice of Ontario pursuant to the Companies' Creditors Arrangement Act, pursuant to which all proceedings against the employer are stayed pending the outcome of those proceedings. The responding employer has now submitted documents, which establish that the stay was operative until November 2, 2001. It therefore appears from the information provided by the responding employer that the stay of proceedings is no longer operative at this time. Unless the Board receives information to the contrary, the hearing scheduled in this matter for Tuesday, November 27, 2001 at 9:30 a.m. at the "Board Offices", 2nd Floor, 505 University Avenue, Toronto, Ontario will proceed in the normal course.
