1These are related matters. Board File No. 3502-00-R is a certification application seeking to displace a unit of employees represented by the intervenor (the “Labourers”) in which a representation vote was held on March 6, 2001. Board File No. 3547-00-U is a section 96 complaint alleging violations of the Labour Relations Act, 1995 (the “Act”) by Carpenters Local 27 and the above named persons.
2There are four issues.
- Scope of the bargaining unit description.
- Who is eligible to vote.
- Allegations filed by Carpenters Local 27 in its letter dated March 13, 2001.
- The section 96 complaint filed by the Labourers’ Union.
3The Board will deal first with the scope of the bargaining unit description in the collective agreement between the Labourers and the employer, Dominion Sheet Metal & Roofing Works (“Dominion”) and the list. Once the list has been determined the Board will deal with the remaining issues.
4These matters are scheduled for continuation on Monday, November 26, Friday, November 30, Tuesday, December 11, and Thursday, December 13, 2001 commencing at 9:30 a.m. in the "Board Room", 2nd Floor, 505 University Avenue, Toronto, Ontario.
