DECISION OF THE BOARD; September 17, 2001
1This is an application under section 68 of the Employment Standards Act, R.S.O. 1990, C.E.-14, as amended (the "Act") seeking review of Order to Pay No. 56225. This application was filed on July 24, 2001 approximately two months after the 45 days provided in the Act for seeking such a review. The applicant asks the Board to exercise its discretion to extend the time for making such an application because it did not receive the Order to Pay until it was advised by the collection agency retained by the Ministry that the monies had been collected.
2The Board hereby directs the responding parties to file submissions with respect to the applicant’s request that the Board extend the date to permit it to file this application for review. The submissions should be received by the Board on or before October 1, 2001. The Ministry of Labour should advise the Board of the circumstances in which it provided the Order to Pay to the applicant, if it asserts that it did so. A copy of the parties’ submissions should also be provided to the applicant.
