Decision of the Board
1Following my decision of October 23, 2000, the applicant, the Canadian Union of Operating Engineers and its Local 101 and the Canadian Union of Public Employees and its Local 1943 reached agreement concerning the description of the service bargaining unit as follows:
all employees of Peterborough Regional Health Centre, in Peterborough, save and except supervisors and foremen, persons above the rank of supervisor and foreman, medical staff, professional and technical staff, office and clerical staff and persons bound by subsisting collective agreements.
2For the purposes of a representation vote, the bargaining unit described above shall form the voting constituency. I order that a representation vote be held on May 16, 2001. Other vote arrangements will be as determined by the Registrar and set out in the attached "Notice of Vote".
3All individuals who have an employment relationship with the applicant in the voting constituency described in paragraph 1 above are eligible to vote.
4Voters will be asked to indicate whether they wish to be represented by
(i) Canadian Union of Public Employees ("CUPE"); or
(ii) Canadian Union of Operating Engineers ("CUOE").
5The applicant is directed to post copies of this decision and of the "Notice of Vote" in a location or locations in the workplace where it is likely to come to the attention of employees who have an interest in participating in the representation vote. These copies must remain posted for 30 days from the date of this decision.
6In the event an issue arises, any party or person who wishes to make representations to the Board about any issue remaining in dispute which relates to the representation vote, must file a detailed statement of representations with the Board and deliver it to the other parties, so that it is received by the Board within five days (excluding Saturdays, Sundays and holidays on which the Board is closed) of the date on which the vote is taken.
7The matter is referred to the Registrar.
