DECISION OF THE BOARD; July 19, 2001
Board File Nos. 1089-01-U and 1105-01-U are applications regarding an unlawful strike or lockout. Board File No. 1090-01-U is an application under section 96 of the Labour Relations Act, 1995 (the “Act”).
Prior to the hearing in this matter the parties entered into Minutes of Settlement dated July 17, 2001, which included the following paragraph:
The parties agree that the following paragraphs shall be included in an order of the Board which shall become effective when the Board is notified that the Editorial bargaining unit has ratified a Collective Agreement.
“It is agreed that Keith Stephen and Robert Frost will continue to be employed in the photography department until these employees resign, retire or are terminated for cause.
Margaret Cameron-McQueen will continue to be given first opportunity to fill in for bargaining unit photographers when they are absent while on vacation. Under these circumstances, she will be employed under terms and conditions of the photography department addendum. Should a full-time position become available in the photography department, Ms. Cameron-McQueen will be given first opportunity to be hired for such position.”
- Having regard to the agreement of the parties dated July 17, 2001 in these matters, and pursuant to section 96 of the Act, the Board makes the following determinations which shall become effective the date the Board is notified that the Editorial bargaining unit has ratified a collective agreement:

- Having regard to the agreement of the parties dated July 17, 2001, these applications are withdrawn by leave of the Board.
