4196-98-R United Brotherhood of Carpenters and Joiners of America, Lake Ontario District Council, Applicant v. Lardale Construction, Lardale Construction Inc., Mel-Ron Construction Limited, Responding Parties.
BEFORE: Christopher J. Albertyn, Vice-Chair, and Board Members G. Pickell and G. McMenemy.
DECISION OF THE BOARD; May 29, 2001
These matters concern a construction grievance and a section 69/1(4) application.
In a letter dated April 23, 2001 the applicant union requests the Board to order the responding parties to produce additional documents, which are described in the letter. The responding parties have already produced “approximately 14 volumes of documents containing thousands of pages”, according to counsel for Lardale Construction.
The Board directs the responding parties to produce the documents described in the applicant’s letter, back to March 11, 1996 (three years before the date of the application).
If the applicant’s counsel wants to obtain copies of any of the responding parties’ documents written prior to March 11, 1996, he may arrange with the responding parties’ counsel to go to the offices of the responding parties to peruse the documents there. He can obtain copies of any such documents at the applicant’s expense.
