DECISION OF THE BOARD; November 27, 2001
This is an employee appeal under section 68 of the Employment Standards Act, R.S.O. 1990 c. E-14, as amended (the “Act”) against the refusal by an Employment Standards Officer to issue an Order to Pay in the applicant’s favour.
The responding employer contends that it is subject to an Order of the Superior Court of Justice of Ontario pursuant to the Companies’ Creditors Arrangement Act, pursuant to which all proceedings against the employer are stayed. The responding employer has now submitted documents, which establish that the Stay Termination Date in that regard has been extended to December 12, 2001.
3, The Board convened a conference call with the parties on November 26, 2001 to entertain their submissions regarding the responding employer’s request that the hearing in this matter scheduled for November 27, 2001 be adjourned in the circumstances. This decision confirms the Board’s oral ruling made at that time that this application is adjourned sine die for a period not exceeding one year. At any time after December 12, 2001 and before the expiry of one year from the date of this decision, any party may request that the Board proceed with the matter. In the absence of such request, this proceeding will be deemed terminated without any further notice to the parties.
