DECISION OF THE BOARD; October 30, 2001
Counsel for the applicant wrote to the Board on September 19, 2001 and again on October 30, 2001. Those letters were only brought to my attention today.
The Board is making arrangements for translation services.
Counsel for the applicant has requested that the responding party and the intervenor provide disclosure of all documents related to the remaining issues (presumably, only those documents which have not yet been produced) in advance of the continuation of this consultation on November 6 and 7, 2001.
I have reviewed the production request. Items (a) to (c) seek the production of documents that are arguably relevant. Indeed, counsel has closely followed the Board’s outline of the remaining issues in formulating his production request. I hereby order that the documents set out in (a) to (c) be produced by no later than 4:30 p.m. on Friday, November 2, 2001. I decline to direct that the employer and the union prepare will say statements or a summary of the evidence they intend to call.
