DECISION OF THE BOARD; July 23, 2001
By decision dated May 31, 2001 the Board directed the parties to make written submissions with respect to the timeliness issue of this application for certification.
Paragraph 15 of that decision directed that “the last of the written submissions must be received by the Board at least three weeks before the continuation of this matter”.
The intervener’s submissions were received by the Board Thursday, July 18, 2001. Reply submissions were received after 5:00 p.m. Friday, July 20, 2001. This matter was scheduled for continuation on Wednesday, July 25, 2001 before all of the submissions had been received by the Board.
The hearing schedule for July 25, 2001 is hereby adjourned. The Board notes that the parties were unable to agree on a number of dates offered by the Board for the continuation of this matter. As the parties are unable to agree on dates the Board will set the dates on a peremptory basis for the continuation of this matter.
After the decision with respect to the timeliness issue has been released the Board will schedule a conference call with the parties and will set the dates for continuation at that time.
