This is a referral of a grievance to the Board for determination under section 133 of the Labour Relations Act, 1995, R.S.O. 1995, c.1 as amended (the “Act”).
By consent, the application is adjourned to November 26, 2001 on the following terms. Mr Octavian Mihai Pinte is subject to his subpoena and shall attend the hearing on November 26, 2001. He shall bring with him all of the following documents:
All employment and payroll records, including statements, time card, records of payments, cheque invoices, banking documents and all other documents writings in his custody, possession or power relating to the employment of construction workers by OCTIVIAN MIHAI PINTE c.o.b. as OTTO’S CONTRACTOR during the period July 2001 and August 2001;
All contracts, subcontracts, agreements, invoices, statements with respect to the subcontracting of construction work for July 2001 and August 2001 to businesses, corporations, business styles and partnerships, or individuals in Ontario;
All letters, remittances forms, documents, voluntary recognition agreements and signed statements directed to or with respect to the Applicant or its Provincial Bargaining Agency;
All contracts, sub-contracts and agreements entered into by OCTAVIAN MIHAI PINTE c.o.b. as OTTO’S CONTRACTOR that pertain to construction work performed during the period of July 2001 and August 2001.
