In its response to this application for certification filed in the construction industry, the employer requested that the Board provide it with the completed Form A-74 Declaration Verifying Membership Evidence.
Counsel noted that the Board routinely provides the equivalent document in non-construction industry applications for certification. Counsel submits that the recent amendments to the Labour Relations Act, 1995 (the "Act"), making section 8.1 apply in the construction industry, render the completed Form A-74 necessary information in order that the employer can decide whether to maintain its section 8.1 challenge.
Before determining whether the Board should change what appears to be longstanding administrative practice differentiating between construction and industrial applications, the Board would like to have the views of the applicant. The applicant is directed to deliver and file any submissions if it wishes to make by Wednesday, May 2, 2001.
The responding party may respond by Monday, May 7, 2001.
