DECISION OF THE BOARD; October 16, 2000
1This is a referral of a grievance filed pursuant to section 133 of the Labour Relations Act, 1995 (the “Act”).
2Pursuant to the agreement of the parties the hearing scheduled for October 16, 2000 is hereby adjourned and the hearing will be rescheduled for November 2, 2000, commencing at 9:30 a.m. in the "Board Room", 2nd Floor, 505 University Avenue, Toronto, Ontario.
3Also pursuant to the agreement of the parties the Board makes the following declarations and orders:
(i) that Stanley Canada Inc. is bound to the Provincial Agreement between the Architectural Glass & Metal Contractors Association and the International Brotherhood of Painters & Allied Trades and the Ontario Council of the International Brotherhood of Painters & Allied Trades effective until April 30, 2001 (the “Provincial Agreement”);
(ii) that Stanley Canada Inc. has violated Article 3 of the Provincial Agreement; and
(iii) that Stanley Canada Inc. disclose all documents relevant to this proceeding, as more particularly described at paragraph 10 of the Applicant’s Form A-86, by no later than October 27, 2000.
