Decision of the Board
1The Board is in receipt of a request for reconsideration dated October 6, 2000 of our decision of the same date. That request is that the Board reconsider its finding that it cannot be absolutely certain that 40% or more of the employees in the bargaining unit are members of the trade union. The responding party objects to the request and states that the Board’s decision should not be changed.
2The request for reconsideration is dismissed.
3While this reconsideration request probably fails on the basis that the Board’s traditional test for reconsideration is not met, the Board nevertheless reviewed the membership evidence and the information supplied by the responding party. The Board is still not absolutely certain that the applicant has the support of forty percent of the employees of the responding party after reviewing the membership evidence of the applicant against the information supplied by the responding party.
4It may be that in the meeting following the vote this issue can be resolved.
