Decision
This is an employee appeal under section 68 of the Employment Standards Act, R.S.O. 1990, c. E.14, as amended (“the Act”) against the refusal by an Employment Standards Officer to issue an Order to Pay in the applicant's favour.
The hearing in this matter commenced on October 5, 2000, and was scheduled for one day. Further dates for the continuation of this matter were discussed and offered to the parties by the Board on October 5, 2000. The parties were directed to respond to the Registrar within 48 hours with respect to their availability on the dates offered. As it turned out, there was no mutual agreement reached, despite the considerable efforts of the parties and Board staff.
Accordingly, I conducted a teleconference with the parties on December 20, 2000 for the sole purpose of establishing continuation hearing dates. With the cooperation of the applicant and counsel for the responding party and the Ministry of Labour, March 9, 12 and 16, 2001 were established for the continuation of this matter. It was also acknowledged that, to the extent necessary to complete the matter, the hearing may extend to 5:00 p.m. on any of the aforementioned continuation dates.
The Registrar is directed to list this matter for continuation on March 9, 12 and 16, 2001. The hearing will commence each day of the continuation at 9:30 a.m. at 505 University Avenue, 2nd Floor, Toronto.
