Applicant: National Automobile, Aerospace, Transportation and General Workers’ Union of Canada (CAW-Canada) Responding Party: St. Joseph’s General Hospital, Elliot Lake (Full Time) Intervenor: Service Employees International Union, Local 204
Before: Marilyn Silverman, Vice‑Chair, and Board Members J. A. Ronson and H. Peacock.
DECISION OF THE BOARD
The Board is in receipt of a request by the intervenor to order that a named individual not be permitted to act as a scrutineer for the applicant because of allegations regarding violations of the Labour Relations Act, 1995, S.O. 1995, c.1 (‘the Act’). At this stage these are allegations that are as yet not responded to. As a Board returning officer will be present to supervise at the vote, the Board is not prepared to make the order requested. Any issues arising out of this matter may be raised at a hearing into this application.

CONCURRING OPINION OF BOARD MEMBER J. A. RONSON
I agree with the disposition by my colleagues of the concerns raised by the intervenor. At the return of this matter before the Board, it is always open to the intervenor to prove the case for another vote.
