1This is an application concerning a work assignment filed under section 99 (1) of the Labour Relations Act, 1995, S.O. 1995, c. 1 as amended (the “Act”). Prior to the commencement of the hearing, the applicant, with the consent of the responding parties who appeared for the scheduled hearing, requested leave of the Board to withdraw this application. The executed request for leave to withdraw and consent was filed with the Board.
2Section 99 (2) of the Act permits an application under section 99 (1) to be withdrawn “by the complainant upon such conditions as the Board may determine.” In view of the parties’ consent to the withdrawal, it is appropriate for the Board not to impose any conditions upon allowing the applicant to withdraw this application.
3This application is withdrawn with leave of the Board at the request of the applicant and on consent of the responding parties appearing at the Board for the scheduled hearing.
