Ontario Labour Relations Board
1803-00-ES 1229062 Ontario Limited (o/a Crestwood Restaurant and Motel), Applicant v. Ministry of Labour, Responding Party.
Employment Practices Branch File No. 21103974
BEFORE: Harry Freedman, Vice-Chair.
DECISION OF THE BOARD; October 31, 2000
1The Crestwood Restaurant and Motel (“Crestwood”) forwarded payment of $1712.96 in respect of Order to Pay No. 59452 to the Director of Employment Standards together with a form indicating that it was applying for a review of the Order to Pay but that the documents relating to the application for review were not attached.
2The Board, by letter dated September 29, 2000, advised Crestwood that a proper application for review had to be filed on the correct forms and provided both the correct forms and other requisite information to enable a proper application to be filed. The letter went on to indicate that the proper application had to be filed within 10 working days of that letter and if it was not filed within that time, the application for review may be terminated.
3The Board, as of the date of this decision, has not received any further material from Crestwood. Under these circumstances, there is no proper application before the Board.
Disposition
4Having regard to the time limit set by the Registrar in his letter to Crestwood dated September 29, 2000 and Crestwood’s failure to file a proper application for review, this proceeding is terminated.
