It is inappropriate to consider the process for adjudicating this case (filed on June 12, 2000) or the related applications (0672-00-M and 0673-00-U filed on May 30) until the potential responding parties have had an opportunity to respond in accordance with the Board’s direction of June 2, 2000. While the applicants assert that the facts are not really in dispute, that assessment can best be made after the responding parties have had an opportunity to file their replies. However, once such filings are made, it may well be appropriate to consider an expedited method of resolving this dispute, along the lines suggested by the applicants.
