DECISION OF THE BOARD; October 26, 2000
1This is an application for review of the decision of an Employment Standards Officer, pursuant to section 68 of the Employment Standards Act as amended by the Economic Development and Workplace Democracy Act, 1998, S.O. 1998, c.8 ("the ESA").
2The workplace parties have entered into Minutes of Settlement dated October 10, 2000. Having regard to the terms of the agreement, the Board makes the following orders:
(i) that the wages paid to the "Director in trust" in relation to this matter be disbursed as follows:
To be paid to the Employer $ 1000.00
To be paid to the Employee $ 2039.94
that the administrative fee as $ 303.99
set out in the Order to Pay be
retained by the Government of
Ontario Consolidated Revenue
Fund
Total amount held by the Director: $ 3343.93
(ii) interest earned on the monies held in trust in this matter is to be paid to the above parties in proportion to the amounts paid out.
3The Ministry of Labour, a responding party to the application but not a signatory to the Minutes of Settlement, shall have ten working days from the date of this decision to request, if necessary, that this matter be relisted for hearing.
DISPOSITION
4In the absence of a request described in paragraph 2, this matter shall be deemed to be terminated.
