DECISION OF THE BOARD; December 11, 2000
1The parties have agreed to resolve all outstanding issues with respect to this certification application by holding another representation vote.
2Having regard to the agreement of the parties, the Board finds that:
all employees of John Ewing & Co. Inc. at 2989 Kennedy Road, Toronto, Ontario, save and except managers, persons above the rank of manager, persons employed in a confidential capacity in matters relating to labour relations, office, clerical and sales staff,
constitute a unit of employees of the responding party appropriate for collective bargaining.
3Having regard to the agreement of the parties the Board directs that a representation vote be taken of the individuals in the above bargaining unit:
all employees of John Ewing & Co. Inc. at 2989 Kennedy Road, Toronto, Ontario, save and except managers, persons above the rank of manager, persons employed in a confidential capacity in matters relating to labour relations, office, clerical and sales staff.
4The vote will be held on December 15, 2000. Other vote arrangements will be as directed by the Registrar and set out on the attached Notice of Vote.
5All individuals who the parties have agreed are in the bargaining unit are eligible to vote.
6Voters will be asked to indicate whether or not they wish to be represented by the applicant in their employment relations with the responding party.
7The responding party is directed to post copies of this decision and of the "Notice of Vote and of Hearing" in places where they are likely to come to the attention of affected employees. These copies must remain posted for 30 days.
8Any party or person who wishes to make representations to the Board with respect to the conduct of the representation vote, must file a detailed statement of representations with the Board and deliver it to the other parties, so that it is received by the Board within five days (excluding Saturdays, Sundays and holidays on which the Board is closed) of the date on which the vote is taken.
9The hearing dates scheduled for December 13, and 14 are hereby cancelled.
10The matter is referred to the Registrar.
