Decision
1This is an application for a review of a decision of an Employment Standards officer pursuant to section 68 of the Employment Standards Act, R.S.O. 1990 ch. E-14 (“the Act”). The application was filed beyond the 45-day limit prescribed by the Act. The applicant has asked the Board to extend the time limits for filing the application pursuant to section 68(4) of the Act. The explanation given by the applicant is generally confirmed by the Ministry of Labour. The Ministry states that it miscommunicated information to the applicant on the status of her file. It further states that the effect of this miscommunication was to cause the applicant to delay the filing of this application until the date on which it was filed.
2In the circumstances, the date for the filing of the application is extended to October 20, 2000, the date on which it was filed. The file is referred to the Manager of Field Services for processing.
