1This is an application under s.96 of the Labour Relations Act, 1995 (the "Act") alleging a violation of section 74 of the Act.
2By letter dated January 5, 1999, counsel for the responding union asserts that the Board has no jurisdiction to hear this matter as the applicant was an employee of Canadian Forces Base-Ottawa and as such his employment relations are not provincially regulated. Counsel provides a copy of the relevant portions of the collective agreement as evidence of the fact that the parties bring their disputes to the Public Service Staff Relations Board.
3In response to this letter, the representative for the applicant responds that "The union is not a member of the armed forces and is therefore subject to Ontario Labour Board Rules."
4The applicant in his reply to the responding union's assertion did not contend that he was not a member of the Canadian Forces Armed Base-Ottawa and the documents provided by the responding union confirm their position. Accordingly, this application is hereby dismissed.
