DECISION OF THE BOARD; September 19, 2000
1The responding parties have filed a "Request for Hearing and Notice of Intend to Defend/Participate (Form A-87). Counsel for the responding parties in his letter of September 12, 2000 advised the Board that "the responding parties do not consent to this matter being deferred for hearing in conjunction with the other grievances as noted in Mr. Minsky's letter of September 5, 2000".
2The Board issued a brief decision on September 12, 2000 which appears to have crossed in the mail with the above request. Assuming this is a request for reconsideration the Board confirms its ruling of September 12, 2000 to defer this grievance pending the determination of the section 69/1(4) applications involving the same responding parties. Paragraph 13 of the September 12, 2000 decision adjourned an earlier grievance (Board File No. 1093-00-G) between the applicant and the same responding parties. There is no useful purpose served in proceeding with this grievance before the related employer/sale of business applications have been determined.
3Whether or not this particular grievance is heard together with the other grievances or on its own, is an issue that can be decided after the section 69/1(4) applications have been determined.
4The Board notes that the responding parties have filed a filing fee for $214.00. This applies to one responding party. The Notice of Intent To Defend names a number of responding parties. However, until the grievance or grievances proceed this filing fee will not be processed.
