1This is a displacement application for certification.
2The intervenor has filed a copy of an appointment of a conciliation officer with respect to the negotiations between itself and the responding party dated February 24, 2000. On its face, the appointment of a conciliation officer would appear to make this application untimely pursuant to section 67 of the Labour Relations Act, 1995 (the “Act”).
3The Board therefore directs the applicant to file submissions with the Board on or before 5:00 p.m. Wednesday, April 5, 2000 providing reasons, if any, why this application should not be dismissed due to untimeliness. Copies of the submissions should be provided to the other parties.
4After reviewing the submissions the Board will decide whether to dismiss the application or process it further.
