Decision
1This is an application under section 68 of the Employment Standards Act, R.S.O. 1990, c. E. 14, as amended (the "Act") for review of Order to Pay No. D 03857 dated August 11, 1999. The application for review was ultimately made several months later and the Board, by decision dated March 9, 2000, extended the time for the filing of the application.
2Counsel for the applicant, by letter dated July 31, 2000 requests that the hearing be expedited but does not set out the grounds for the Board doing so. It appears from the material filed that the applicant disputes that there is any money owing to the claimants in respect of whom the Order to Pay was issued. Nevertheless, counsel for the applicant indicates that although the applicant is content with the inquiries made by the Labour Relations Officer of the claimants who attended at the settlement meeting and will not require those individuals to testify at the hearing of the application, he does continue to dispute the claims made by the claimants who did not attend that meeting.
3The Board must set its priorities for scheduling matters given the limited resources it has available. In the absence of compelling reasons for expediting the hearing of this application (and none were set out in the request), there is no basis for the Board to do so. In the circumstances, this matter is referred to the Registrar to be listed for hearing in the ordinary course.
