DECISION OF THE BOARD; September 21, 2000
The style of cause is hereby amended to reflect the correct name of the responding party: “The Korea Times Ltd.”.
In the Board’s decision dated September 6, 2000, the Board ruled that it was unable to determine under section 8.1 of the Act whether forty per cent or more of employees in the bargaining unit were members of the applicant at the time of the application for certification.
The Board has been provided with additional information to assist it in coming to its determination. Based on that information the Board finds that the employer’s 8.1 objection is not numerically relevant. In fact, more than forty per cent of the employees in the bargaining unit were members of the trade union even if the employer ‘s estimate of the number of employees in the bargaining unit is correct.
The remaining issue in dispute will be determined at the hearing, if necessary. In the meantime, this matter is referred to the Manager of Field Services for a regional certification meeting.
