1These are applications for certification.
2The applicants in both cases seek to represent the same employees who are subject to an application for certification by the United Food and Commercial Workers’ Union, Local 233 (Board File 2478-00-R) which was filed on November 21, 2000.
3A representation vote has been taken. Section 111(3) of the Labour Relations Act, 1995 (the “Act”) grants to the Board wide discretion about what to do with subsequent applications for certification. In accordance with its usual practice, the Board will postpone consideration of these subsequent applications until a final decision has been issued on the original application.
4These matters are referred to the Registrar.
5In Board File 2743-00-R, counsel for the applicant requested that the evidence of membership it filed with the Board (but did not deliver to the other parties) in File 2478-00-R in support of its request to intervene, be transferred to support its own application. Having regard to the level of membership evidence the applicant filed in No. 2743-00-R, it is not necessary for the Board to determine whether and how it can do what the applicant asks.
6The responding party is directed to post this decision alongside the other Board notices. If any procedural issues arise with respect to these matters, the Registrar is directed to place them before this panel of the Board, if practical.
