Ontario Labour Relations Board
File No.: 2221-00-U Date: November 14, 2000
Between: Rick Ward, Applicant v. CAW Local 1973 – CAW National and General Motors Transmission Plant, Responding Parties.
Before: Bram Herlich, Vice‑Chair.
DECISION OF THE BOARD
1This is an application filed pursuant to section 96 of the Act alleging that the responding party trade union has violated section 74 of the Act.
2The responding party (the "union") has requested an extension of time for filing its response.
3The employer (in correspondence which has been delivered to the other parties) has indicated that it wishes to intervene. It indicates, however, that by virtue of the nature of the complaint, the applicant ought to be directed to consent to the release to the employer of certain information in the possession of the employer's medical staff.
4The Board has reviewed the application and is, frankly, unable to discern from it the nature of the applicant's complaint.
5For example, by marking the appropriate box on the application form, the applicant asserts that he has lost his employment. Unfortunately, the narrative description of events included in the application is so incoherent, that the Board is unable to discern the nature of the facts alleged.
6There are numerous documents attached to the application, some of which are of considerable vintage.
7The only explicit reference to any termination appears to date to September, 1981.
8Unless and until the applicant files a revised application which includes a summary of all of the relevant facts, a description of the specific acts which are said to be contrary to the Act, and an indication of the nature of the relief being sought, the Board will not consider this application further.
9It follows that neither the union nor the employer is required to file any response until such time as the applicant files a proper application.
10If the applicant fails to make any further filings within 20 days of the date of this decision, this application will be deemed to have been dismissed.
