2811-99-FC I.W.A. Canada, Local 2693, Applicant v. Le Centre de Santé Communautaire de Sudbury, Responding Party.
BEFORE: Mary Ellen Cummings, Alternate Chair.
DECISION OF THE BOARD; April 12, 2000
The responding party has requested an adjournment of this matter which is scheduled to be heard on April 18, 19 and 20, 2000.
The basis for the adjournment request is that the parties are continuing to negotiate, with dates scheduled into May and June 2000. Further, the responding party’s representative is not available because she will be out of the country. The responding party has not been successful in getting a response to its request to adjourn from the applicant.
Without consent, one party’s unavailability to attend a scheduled hearing is not a basis for an adjournment. However, the request to adjourn caused the Board to look at the application.
The only issue identified is a dispute about the language in which negotiations would be conducted. Prior to the dates when this matter was to come on for hearing in January, the parties entered into an agreement about how they would resolve the linguistic dispute for negotiations. There appear to be no outstanding matters that require the Board’s intervention.
Consequently, this matter is adjourned sine die. If neither party seeks to bring it on for hearing within one year from the date of this decision, the matter will be terminated without further notice to the parties.
