This is an application for the referral of a grievance to arbitration pursuant to section 133 of the Labour Relations Act, 1995, S.O. 1995 ch. 1 (the "Act"). The applicant has asked that the Board determine the referral without a hearing and with reference only to the material in the file if the responding party does not file a Notice of Intent to Defend. The responding party has filed nothing. Nonetheless, given the issues raised in this application, it would be inappropriate to do so. This matter remains set for hearing on November 28, 2000.
