DECISION OF THE BOARD; October 16, 2000
This is an application for review of an Officer's decision not to issue an Order to Pay. Section 68(3) of the Employment Standards Act requires that applications for review be made within 45 days of the date of the Officer's decision. This application was filed approximately 3 weeks late. Section 68 of the Act permits the Board to extend the time for applying if the Board considers it appropriate to do so.
The applicant requested an extension of time. He submitted that there has been confusion and uncertainty surrounding the sale of his employer, its subsequent closure and what funds would be available.
Having regard to the reasons offered, and the relatively brief period of delay, the Board considers it appropriate to extend the time and treat this application as timely.
DISPOSITION
- This application is considered timely and may proceed.
