DECISION OF THE BOARD; October 12, 2000
The Board has received correspondence from the applicant in this matter, dated September 28, 2000. Having regard to the remedial issues raised in that letter, the Board makes the following directions:
(1) the responding party employer is hereby directed to provide to the Board and to the applicant a statement of its position on the matters raised in the applicant's correspondence, and in particular its proposal as to the amount of compensation that should be paid in accordance with paragraph 74 of the Board's decision dated April 7, 1999, and the appropriate method and timing of such compensation, by October 27, 2000;
(2) the responding party employer is further directed to provide to the applicant and to the Board, by October 27, 2000, a list of all drivers who made lease payments to the company during the period between November 1, 1997 and the present, setting out the amounts of such payments made in each month. The union shall be permitted reasonable access to the records used to prepare this list, upon application to the Board, should there be any dispute over the information provided by the company;
(3) the matter is referred to the Manager of Field Services for the appointment of a Labour Relations Officer, to meet with the parties in Ottawa after October 27, 2000 to attempt to negotiate a resolution of the dispute over compensation, and any other outstanding issues arising from the Board's decisions in this matter;
(4) should the matter not be resolved, the Board will review the submissions of the parties and make whatever further directions are required.
