Decision of the Board
1The applicant has referred a grievance concerning the interpretation, application, administration or alleged violation of a collective agreement to the Board for final and binding determination.
2Prior to the hearing in this matter, the parties entered into a memorandum of agreement dated March 6, 2000.
3Having regard to the memorandum of agreement, to the material before it and pursuant to section 133 of the Labour Relations Act, 1995 the Board makes the following declarations and directions:
The Board declares that Black & McDonald Ltd. is bound to the collective agreement effective May 1 1998 to April 30, 2001 as between the Electrical Trade Bargaining Agency of the Electrical Contractors Association of Ontario and the International Brotherhood of Electrical Workers and the IBEW Construction Council of Ontario.
The Board declares that Black & McDonald Ltd. has violated the collective agreement mentioned above and in particular Articles 5:05 and 5:07.
The Board orders Black & McDonald Ltd. to pay to the applicant, within seven days of the date of the Memorandum of Agreement, as damages, the amount of six thousand two hundred dollars ($6,200.00) as full and final settlement of the violations of the collective agreement.
