Lieutenant David Walker, Applicant v. Ministry of the Solicitor General & Correctional Services, Maplehurst Correctional Centre, Responding Party.
Before: Harry Freedman, Vice-Chair.
Decision of the Board: January 31, 2000
Decision
1After 5 p.m. on Friday, January 28, 2000 counsel for the Ontario Public Service Employees Union transmitted to the Board a copy of a letter dated January 17, 2000 he had received from counsel for the Ministry of the Solicitor General & Correctional Services. That letter had not been received by the Registrar’s office, although it was addressed to the Registrar, from counsel for the Ministry of the Solicitor General & Correctional Services.
2In that letter counsel for the Ministry of the Solicitor General & Correctional Services advises that due to medical reasons, she will not be able to attend the hearing on January 31 and on the dates scheduled in February in this matter. Counsel for the Ontario Public Service Employees Union advised in the transmittal sheet with that letter that:
“The attached request for an adjournment was received by our office on January 17, 2000. As the matter had been previously discussed with all parties and the Vice-Chair, we assumed that this matter would be adjourned as the only uncertainty was the date Ms. Williams’ medical leave would commence. We consent to the adjournment and we believe that all other parties consented as well.”
3In the circumstances, the Board hereby adjourns the hearings scheduled in this matter for January 31, February 1, 2, 7, 8, 9 28 and 29, 2000. The hearings will continue on the previously scheduled dates in June.
